Important Notice: This is a translation of the original Japanese Terms of Service. In the event of any discrepancy or conflict between this English version and the Japanese version, the Japanese version shall prevail for all legal interpretations and obligations.
Article 1 (Application)
These Terms of Service (“Terms”) set forth the terms and conditions for the use of this service (“Service”). All registered users (“Users”) shall use the Service in accordance with these Terms.
Article 2 (User Registration)
- In this Service, user registration shall be completed when a registration applicant agrees to these Terms and applies for user registration by the method prescribed by the business operator, and the business operator approves such application.
- The business operator may refuse to approve an application for user registration if it determines that the applicant has any of the following reasons, and shall have no obligation to disclose the reasons therefor.
- If false information is provided in the application for user registration
- If the application is from a person who has violated these Terms
- If the business operator determines that user registration is not appropriate for other reasons
Article 3 (User Management)
Users may not share their account with third parties under any circumstances.
Article 4 (Prohibited Acts)
Users shall not engage in any of the following acts when using the Service:
- Acts that violate laws or public order and morals
- Acts related to criminal activities
- Acts that infringe on the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the business operator, other Users, or other third parties
- Acts that destroy or interfere with the functions of the business operator’s servers or networks
- Acts that may interfere with the operation of the business operator’s services
- Acts of unauthorized access or attempts thereof
- Acts of collecting or accumulating personal information about other Users
- Acts of using the Service for fraudulent purposes
- Other acts that the business operator deems inappropriate
Article 5 (Suspension of Service Provision)
The Service may, in principle after providing advance notice to Users, suspend or interrupt the provision of all or part of the Service if it determines that any of the following reasons exist. However, this shall not apply in cases of emergency.
- When maintenance, inspection, or updating of the computer system related to the Service is performed
- When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
- When computers or communication lines stop due to accidents
- When the business operator determines that it is difficult to provide the Service for other reasons
Article 6 (Disclaimer)
The business operator shall not be liable for any transactions, communications, or disputes that arise between Users and other Users or third parties in relation to the Service, except in cases of gross negligence or willful misconduct by the business operator.
Article 7 (Changes to Service Content)
The business operator may change the content of the Service or discontinue the provision of the Service at the business operator’s discretion. When making changes disadvantageous to Users or discontinuing the Service, the business operator shall notify Users with a reasonable advance notice period. The business operator shall not be liable for any damages caused to Users thereby, except in cases of gross negligence or willful misconduct by the business operator.
Article 8 (Changes to Terms of Service)
- The business operator may change these Terms without obtaining individual consent from Users in the following cases: (1) When the changes to these Terms are in the general interest of Users. (2) When the changes to these Terms do not contradict the purpose of the contract and are reasonable in light of the necessity of the changes, the appropriateness of the changed content, and other circumstances related to the changes.
- When changing these Terms pursuant to the preceding paragraph, the business operator shall notify Users by appropriate means such as posting on the business operator’s website, a reasonable period before the effective date of the changed Terms, of the fact that the Terms will be changed, the content of the changed Terms, and the effective date.
- If a User uses the Service after the effective date of the changed Terms, the User shall be deemed to have agreed to the changes to the Terms.
Article 9 (Governing Law and Jurisdiction)
- These Terms shall be governed by Japanese law.
- In the event of any dispute arising in connection with the Service, the court having jurisdiction over the location of the business operator’s head office shall have exclusive jurisdiction.
